This Data Privacy Policy ("Policy") explains how we collect, use, store, and protect your personal information when you use the BizEats Customer App and related services (collectively, the "Services"). By accessing or using our Services, you agree to the practices described in this Policy. This Policy is compliant with Republic Act No. 10173 – Data Privacy Act of 2012 of the Philippines and its Implementing Rules and Regulations.
1. Definitions
- "BizEats" refers to the platform operated by Idealaunch Software Development Services.
- "Personal Information Controller (PIC)" refers to BizEats, which determines the purposes and means of processing your personal data.
- "Customer" refers to end-users placing orders via the BizEats Delivery App.
- "Personal Data" means any information that identifies or can reasonably be used to identify you as an individual.
2. What Data We Collect
We collect personal information necessary to provide you with a seamless food ordering and delivery experience. This includes:
- Account Information – Full name, email address, phone number, and profile photo provided during registration.
- Delivery Address – Your home, work, or any saved delivery locations.
- Order History – Items ordered, timestamps, order amounts, and restaurant preferences.
- Location Data – Real-time GPS location during active orders to enable delivery tracking and accurate routing.
- Payment Information – Payment method type (e.g., cash on delivery, e-wallet). We do not store full card numbers.
- Device Information – Device model, operating system version, app version, and unique device identifiers.
- Communications – Messages or feedback you submit to our customer support team.
3. How We Use Your Data
We use your personal data only for the following lawful purposes:
- To process and fulfill your food orders and arrange delivery.
- To create, manage, and secure your BizEats account.
- To send order status notifications (e.g., confirmed, in-kitchen, on the way, and delivered).
- To calculate delivery fees and estimated arrival times based on your location.
- To provide customer support and resolve disputes or complaints.
- To improve our platform, features, and overall user experience through anonymized analytics.
- To send you promotional offers and updates — only with your consent. You may opt out at any time through your in-app notification settings.
- To comply with applicable laws and regulations in the Philippines.
4. Data Sharing & Third Parties
We do not sell your personal information. However, we may share your data with the following parties to deliver our Services:
A. Restaurant Partners (Merchants)
When you place an order, your name, contact number, and delivery address are shared with the Merchant to facilitate accurate order preparation and handoff to the delivery rider.
B. Delivery Riders
Riders are provided with your name, delivery address, and contact number to complete the delivery. Your location may be shared during active deliveries to improve routing accuracy.
C. Technology Service Providers
We work with trusted third-party providers (such as cloud hosting, SMS gateways, mapping services, and analytics tools) that process data strictly on our behalf. These providers are contractually bound to handle your data securely and only for the purposes we specify.
D. Legal Obligations
We may disclose your information to government authorities or law enforcement if required by applicable Philippine law, court order, or to protect the rights, safety, and property of BizEats, its users, or the public.
5. Location Data
The BizEats App requests access to your device's GPS location to enable the following features:
- Auto-detecting your delivery address for faster checkout.
- Calculating accurate delivery fees and estimated arrival times.
- Allowing you to track your rider in real-time on the map.
- Helping riders navigate to your delivery location accurately.
Location access is used only while the app is active. You may manage location permissions at any time through your device settings. Disabling location access may limit certain app features. Location data is not stored beyond the completion of each delivery session.
6. Data Retention
We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected and as required by applicable Philippine laws:
- Account data – Retained for as long as your account remains active.
- Order history – Retained for a minimum of 3 years for business and legal compliance purposes.
- Support communications – Retained for up to 2 years after the issue is resolved.
- Location data – Not stored beyond the completion of each delivery session.
Upon account deletion, your personal data will be anonymized or securely deleted within 30 days, except where retention is required by law.
7. Your Rights
Under the Data Privacy Act of 2012 (RA 10173), you have the following rights regarding your personal data:
- Right to be Informed – Know what personal data we collect and how it is used.
- Right to Access – Request a copy of the personal data we hold about you.
- Right to Correction – Request correction of inaccurate or incomplete personal data.
- Right to Erasure – Request deletion of your personal data, subject to applicable legal obligations.
- Right to Object – Object to the processing of your personal data, including for direct marketing.
- Right to Data Portability – Request your personal data in a structured, machine-readable format.
- Right to File a Complaint – Lodge a complaint with the National Privacy Commission (NPC) of the Philippines at www.privacy.gov.ph.

8. Data Security
We implement appropriate technical and organizational measures to protect your personal data from unauthorized access, disclosure, alteration, or destruction. These include encrypted data transmission (HTTPS/TLS), secure cloud storage with role-based access controls, and regular security reviews.
While we strive to protect your information, no method of internet transmission is 100% secure. We encourage you to use a strong, unique password for your BizEats account and to log out when using shared devices.
9. Children's Privacy
The BizEats App is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that a minor has provided personal data without verifiable parental consent, we will delete such information promptly. If you believe a minor has registered on our platform, please contact us immediately at hello@biz-eats.com.
10. Changes to This Policy
We may update this Data Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the "Last Updated" date at the top of this page and notify registered users via in-app notification or email. Your continued use of the Services after any changes constitutes your acceptance of the updated Policy.
