Welcome to BizEats. These Terms and Conditions ("Terms") govern your use of our website, our restaurant management system (POS), and our delivery application (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Definitions

  • "BizEats" refers to the platform provided by Idealaunch Software Development Services.
  • "Merchant" or "Partner" refers to restaurants, food stalls, or businesses using our POS and platform to sell goods.
  • "Customer" refers to end-users placing orders via the BizEats Delivery App.
  • "Services" means all applications, software, and websites operated by BizEats.

2. For Restaurant Partners (Merchants)

A. Account Registration

To use the BizEats POS and Merchant Dashboard, you must register an account and provide accurate business information. You are responsible for maintaining the confidentiality of your account credentials.

B. Fees and Payments

Merchants agree to pay the applicable Upfront Activation Fees and Monthly Platform Support Fees as outlined in their specific Service Agreement. Failure to settle fees within the stipulated period may result in temporary suspension or termination of services.

C. Order Fulfillment

Merchants are responsible for the quality, safety, and hygiene of the food prepared. BizEats is a technology provider and is not liable for the quality of the food items served or delivered.

3. For Customers (End-Users)

A. Ordering Process

When placing an order through the BizEats App, you agree that all information provided (address, contact details) is accurate. Orders are subject to acceptance by the Merchant and availability of items.

B. Pricing

Prices listed on the BizEats App may include a markup service fee on top of the Merchant's dine-in prices to cover platform operational costs. Delivery fees are calculated separately based on location.

C. Cancellations

Customers may cancel an order only if the Merchant has not yet started preparing the food. Once the order status is "In Kitchen" or "Preparing," cancellations are no longer permitted and you may be charged the full amount.

4. Intellectual Property

The BizEats source code, logos, designs, and content are protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Services without written permission from Idealaunch.

5. Limitation of Liability

BizEats provides the Services on an "as is" and "as available" basis. We do not guarantee that the Services will be uninterrupted or error-free. To the fullest extent permitted by law, BizEats shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

6. Termination

We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be resolved in the competent courts of Bislig City, Surigao del Sur.
